Terms of Service
Effective August 23, 2026
Games are user-created and take place at real locations. A listing is not permission to enter property, a safety inspection, or an endorsement by indieSoccer. You are responsible for verifying access and deciding whether participation is appropriate.
1. Agreement and operator
These Terms of Service (“Terms”) are an agreement between you and Rush Farinella, operator of indieSoccer (“indieSoccer,” “we,” “us,” or “our”). By creating an account, accessing, or using the indieSoccer app and related services (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Apple’s license terms
Apple’s Standard Licensed Application End User License Agreement governs your license to the iOS app. These Terms separately govern your indieSoccer account and use of the Service. If these Terms conflict with Apple’s Standard EULA concerning the app license, Apple’s Standard EULA controls for that license.
3. Eligibility and territory
You must be at least 18 years old, be located in the United States, and be legally able to enter into these Terms to create an account or use the Service. Do not use indieSoccer if your use would violate applicable law.
4. What indieSoccer is
indieSoccer is software that lets users create, find, join, organize, and discuss soccer games. indieSoccer is not a sports league, team, coach, referee, venue owner, property manager, event organizer, transportation provider, medical provider, emergency service, or insurer. Unless we expressly say otherwise in a separate written agreement, indieSoccer does not organize, supervise, staff, approve, sponsor, or operate any game or location shown in the Service.
5. User-created games and locations
Games, locations, schedules, descriptions, participant lists, messages, and other materials may be submitted by users (“User Content”). User Content may be incomplete, inaccurate, outdated, misleading, unauthorized, or unsafe. A location shown in the Service is not a representation that it is open, available, legal to use, suitable for soccer, accessible, reserved, or approved by its owner or manager.
Before attending or creating a game, independently confirm permission to enter and use the location, comply with posted rules and laws, obtain any required reservation or permit, and respect neighbors, property, staff, and other visitors. Do not trespass, block access, damage property, or treat the Service as permission to enter property.
6. Sports, travel, and injury risks
Soccer and travel to or from a game involve inherent and other risks, including falls, collisions, contact with people or objects, uneven surfaces, weather, traffic, theft, illness, serious injury, permanent disability, property loss, and death. You voluntarily assume the ordinary risks of choosing to participate and are responsible for deciding whether you are physically and medically able to do so.
Inspect the location and current conditions yourself, use appropriate equipment, follow applicable rules, and stop playing when conditions are unsafe. indieSoccer does not provide medical, emergency, safety, or coaching advice. Call local emergency services in an emergency.
7. Accounts
Provide accurate information and keep your account and device secure. You are responsible for activity under your account and must promptly report suspected unauthorized access to info@indiesoccer.app. Do not impersonate another person, share or transfer your account, create an account for someone without permission, or evade a suspension or restriction.
8. Game mechanics
The Service includes mechanics such as joining and leaving games, access requests, teams and positions, daily participation limits, check-in, attendance, cancellations, reliability, Elo, game results, and notifications. Current explanations appear in the app where relevant.
Ratings, percentages, reliability indicators, statistics, and other calculations are estimates or service mechanics. They may be corrected, recalculated, delayed, or changed and have no cash value. You remain responsible for confirming game details and your own commitments.
9. Acceptable use
You may not use the Service to:
- threaten, harass, stalk, deceive, discriminate against, exploit, or endanger anyone;
- organize unlawful activity, trespass, or misrepresent that indieSoccer sponsors or operates a game;
- share another person’s private information or precise location without permission;
- upload illegal, infringing, deceptive, or harmful material;
- spam, scrape, reverse engineer, probe, disrupt, or bypass security or access controls;
- manipulate check-in, ratings, reports, purchases, game results, or other Service mechanics; or
- use the Service in a way that violates law, another person’s rights, or these Terms.
10. User Content
You retain ownership of User Content you submit. You grant Rush Farinella a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, display, and transmit that content only as reasonably needed to operate, secure, maintain, and improve the Service.
You represent that you have the rights and permissions needed to submit User Content and that it does not violate law, privacy, publicity, intellectual-property, or other rights. Do not upload images, names, contact information, or location details about another person without appropriate permission. We may restrict or remove content as described below.
11. Messages, moderation, and reports
Messages are communications between users, not private communications with indieSoccer. We may review content when it is reported or when reasonably necessary for safety, security, enforcement, support, or legal compliance.
We may, but do not promise to, review, restrict, remove, disable, preserve, or report User Content or accounts. Moderation may not be immediate, complete, or correct. Reports are not emergency requests. Contact info@indiesoccer.app for a safety or support concern and contact local emergency services for an emergency.
12. Purchases
The Service may include free and paid features. Applicable prices and material purchase terms will be shown before purchase. Apple processes App Store purchases, renewals, cancellations, and refunds under Apple’s rules. Fees do not make indieSoccer the organizer, operator, or insurer of a game. Except where required by law or expressly stated, fees are nonrefundable.
13. Intellectual property
The Service, including its software, visual design, names, graphics, and operator-created content, is owned by or licensed to Rush Farinella and protected by law. Subject to Apple’s Standard EULA and these Terms, you may use the Service for your personal, lawful, noncommercial use. No other rights are granted.
14. Third-party services
The Service uses or links to third-party services for maps, authentication, payments, notifications, hosting, analytics, and communications. We do not control third-party services, and their terms and privacy practices may separately apply.
15. Suspension, termination, and deletion
We may restrict, suspend, or terminate an account or access when we reasonably believe there has been a violation of these Terms, fraud, misuse, or a safety, security, or legal risk. You may stop using the Service and initiate account deletion through Settings → Delete Account.
Provisions that by their nature should survive termination—including ownership, content licenses needed for retained records, disclaimers, liability limits, indemnification, and dispute provisions—will survive.
16. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
indieSoccer does not warrant or guarantee any user’s identity, skill, age, health, conduct, trustworthiness, or safety; any game or location’s accuracy, availability, condition, legality, or safety; or that another user will attend or behave as expected. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
17. Release and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND HOLD HARMLESS RUSH FARINELLA, INDIESOCCER, AND THEIR CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS FROM CLAIMS ARISING OUT OF OR RELATED TO USER CONTENT, GAMES, LOCATIONS, PARTICIPATION, TRAVEL, OTHER USERS, PROPERTY ACCESS, INJURY, DEATH, PROPERTY DAMAGE, OR YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THESE PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES. THEIR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100.
These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.
18. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Rush Farinella, indieSoccer, and their contractors, affiliates, licensors, and service providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your User Content, games you create or organize, access to property, conduct, violation of these Terms, or violation of another person’s rights or applicable law.
19. Changes
We may change the Service or these Terms. We will provide notice of material changes and obtain renewed agreement when required by law. The updated effective date will appear above. If you do not agree to revised Terms, stop using the Service and delete your account.
20. North Carolina law and courts
These Terms are governed by North Carolina law, without regard to conflict-of-law rules. Any lawsuit arising from these Terms or the Service must be brought in a state or federal court located in Wake County, North Carolina, and each party consents to that court’s jurisdiction and venue, except where applicable law requires otherwise.
These Terms do not require arbitration and do not waive either party’s ability to participate in a class action where otherwise permitted by law.
21. General terms
If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets. These Terms, the Privacy Policy, and documents expressly incorporated into them are the entire agreement concerning the Service.
